Before posting bond, be aware of the following:

  • Bond must be posted in cash, cashier's check or by credit card.
  • A surety bond may be used and obtained through a bondsman. The bondsman is then responsible for filing the proper paperwork with the court to insure the bond.
  • If you post bond for a defendant, you may post bond at the jail or at the 48th District Court. You may post bond at the 48th District Court for 48th District Court cases only. We cannot accept bonds on cases filed in other courts.
  • If you post a bond for a defendant and that defendant fails to appear for court, your bond will be forfeited.
  • If bond is posted by a 3rd party, bond will be returned after fines and costs are paid in full or, in some cases, not until the defendant is discharged from probation.
  • If bond is posted by the defendant, it will be applied to fines and costs.
  • If you are posting a 10% bond, 90% of the bond will be used for fines and costs. The Court will retain 10% of the bond pursuant to Michigan Court Rule 6.106 (I)(1). The entire bond will be returned to the poster if the case is unconditionally dismissed.

Example: Your bond is set at $1,000 with a 10% provision allowed. You would have to post $100. If the bond was returned to you, you would receive a check for $90 and the Court would retain $10.
